It appears that after the most recent maintenance break, tournaments can have more people then their cap. I am assuming this happens because a player has the join icon shown in green before the tournament is full and successfully presses it after, however I am not positive.
Tournament Data:
Capacity on info card: 90/100
Real capacity: 102/100
Type: Open
Tag: #29289LY
If you view this and the capacity is under 102/100 that is because people have left.
